A person came in front of car and died

My friend was driving his father's car, suddenly one men fall-down in the road in front of his car and my friend don't have that much time to hit the break and save that men, this incident happened in just 2 second. So that men was suddenly fall-down in front of his car and met an accident. That men was dead at that time on accident spot. After that my friend call the nearest police and tell them what is actually happened. Now i want to ask you that what is the legal sections are apply on my friend?? My second question is that is this "hit and run" case ?? because the opposition lawyer put this case as hit and run case. My friend was not run away from accident spot after the accident.So what to do in that case ??

When any accident is happen the owner / driver of vehicle has to inform to the police.

If driver had valid License, vehicle with fitness certificate and Insurance, under the Motor Vehicle Claim the demised person family members will get compensation otherwise it is liable on your friend.

You can get acquired in hit and run case if your Advocate is capable.

Section 279 and 304 A of Indian penal code are applicable, your friend has to get bail and it is easily given as it is a bailable case, normally the police will book as hit and run further just get bail and proceed with the trail and get acquitted.
