498a husband fir quashing based on mediation

04-Sep-2025 (In Criminal Law)
On high court mediation, my parents FIR has been quashed. And the mediator informed me that my/husband FIR will also be quashed, I must apply for quashing. But my lawyer is not applying for quashing and told husband FIR may not get quashed. Please advise below (attaching judgement copy for your reference). 1. Mediator informed me that based on the mediation not only my/husband FIR will be quashed, but wife also cannot file any other criminal case against me. Is this true?

Its depends on facts on circumstances of each case you cannot straightaway come to conclusion getting quashedin most of the cases FIR against the husband will not be quashed due to specific allegation but even there are cases that got quashed. If both parties settled the matter in mediation you can get the quashed in the high court and yes further litigation will ended as mediatior advised

Dear Sir, Your Advocate is correct. The Supreme Court says that mechanically the FIR against husbands should not be quashed. Thus, it is very difficult to get quash FIR which is pending against you unless there is strong evidence and counter FIR against your wife otherwise it will be a wasteful exercise to go to High Court seeking quash.
