420 case not compounding without complainant after settlement

The judge is insisting us to argue on charges even after settlement has taken place in 420 case and complete amount is paid through mediation but now the complainant is not appearing, even after summons through DCP. Also contacted high court legal aid for quashing but they are reluctant and are asking us to convince the lower court to discharge without trial. what should we now do in lower court as next date is put up for argument on charges. can quashing be done after charges are framed?

Yes, the quashing can be done even after framing of the charges. If the complainant is hostile, you may go for filing an application discharge in accordance with Section 249, Cr.P.C. For assistance you may consult me.
