My friend has been arrested for 326. hence there is no proof against him. Just political pressure.
bail has been rejected by lower court bcs he was already arrested and to apply for bail in session court we had to apply first in lower court. Thats what the advocate told us.
Nowadays are chances to get bail in session court?
The lower court made a mistake in rejecting the bail application under section 437 crpc in a case of 326 IPC. 326 ipc can be imposed after getting report from the doctor board which is constituted after receiving xray report. if there is no report of doctor then offence under 326 can not be established.
