Wife has taken maternity leave is she eligible for the new law

Hi, I have an query my wife has taken maternity leave from January 2017 is she is eligible for the new law where she can avail 26 weeks with pay.
The MB Amendment has become effective from April 1 and benefits can be availed by all expecting mothers who are in employment.The MB Amendment Act has also introduced an enabling provision relating to “work from home” for women, which may be exercised after the expiry of the 26 weeks’ leave period.Depending upon the nature of work, women employees may be able to avail this benefit on terms that are mutually agreed with the employer.

The law on maternity leave that is passed can not and will not be retrospective. The law is prospective. People who go on maternity leave after the law came into existence are the ones who can take 26 weeks leave
