Regarding offered job termination

I have offered job for Nagpur location before lockdown. I was suppose to join new company on 25/4/2020 but my new employer told as joining are delayed due to covid. I waited till now they are saying they can offer me job for Warli location but I'm not looking to relocate and this job was initially offered for Nagpur location. I have already been released from my since 20/4/2020 and after waiting so long new employer is saying if I don't join Warli Mumbai location they need to terminate my offer letter. I have been jobless since long because of them and today got this news. Im seeking you expert advice can I take legal action on them and get demand penalty from them for such unfair practices. I will look forward to your advice.

Well, if they have promised you in written, then obviously : 'Yes', you can take a legal action against them and file your case for breach of promise or breach of contract as per the Contract Act, 1872. You can claim hefty amount of compensation from them.

Most companies include in their offer letter a clause saying that you can be transferred to any location as per the companies requirement. In which case, a claim in that regard will be difficult to maintain. It is possible that you may have a claim for the denial of legitimate expectations due to the delay in joining time. However, the contract will need to be examined before a conclusive answer
