My company send me Employment Separation Notice on mail.

Please find below the mail which HR has send to me : Based on a current unfortunate situation we are in, initial planned project is no longer in scope & we do not have any relevant work in the organization matching your skills & experience hence we wish to amicably bring closure to your employment. This decision has been taken in the best interest of both, yourself and the organization. As discussed your notice period will be starting effective Monday, 4th May, 2020 & Thursday, 2nd July, 2020 will be considered as your last paid day. In case you need an early relieving than the above mentioned date you may write to us and we’ll arrange for the same. Also, if you need further extension, that will be considered as a leave without pay extension and you are required to inform us 2 days before completion of your notice period. I have 3 months notice period and they are giving me two months time. appraisal is pending since January 2020. What should i response legally on this mail?

you can take legal action against them since they are terminating you due to COVID-19. The MHA has given a direction pertaining to termination of employees and therefore the action of your company can be challenged.

Sir.. Regarding this we have to see your contract and find if there is FORCE MAJEAURE clause in it. In addition to this we also have to see what kind of work you were doing in the Company.. You can take the help of Notification issued by Ministry of Notification, but still your nature of work have to be seen.. Regarding giving reply to the Company you can contact us..

well, company can demand/lay off. but, as per law only. during this covid19 period, it shouldnt be but practically its becoming tough to sustain even for a company. so you may request them, else issue legal notice for complete 3 months salary alongwith increment which is pending including compensation alongwith copy to ministry of employment and labour officer
