Legal action to be taken if undated cheque gets bounced

Employer has provided me cheque of 2 lac rs, but refuses to submit it whenever i ask him to pay and make excuse not to have sufficient money in account. What if i submit cheque in the respected bank.Date is not given on the cheque also.how can i get my money if cheque is bounced.?

You can present a cheque after filing an appropriate date on the same and if the same is not honoured by the back due to insufficient balance then you can file a case under section 138 of the NI Act for making good the payment.

In this case first of all you should have to contact a lawyer known to you.
Or else as you have open your query here then it is suggested you to contact any of the lawyer as soon as possible.

You can sue him if cheques are bounced from the bank make sure after cheque bounce u immediately follow the procedure for sec138 otherwise u won't be able to file case against him. Employer can be arrested as well than he may compromise with u regarding ur salary contact for complete information.

Has your employer signed the cheque? If yes then you may present it for encashment and fill the date yourself and if asked later, then state that it was done on understanding with your employer. If the cheque bounces, you have to give notice and file case under section 138 NI Act, all within stipulated period. You have to state reason for cheque bounce. Do not present undated cheque to Bank. You may contact lawyer for imp advise along with the relevant details.
