If an employee started their own company while working for you, diverted clients, and stole valuable data, there are legal actions you can take to protect your business and seek damages. First, gather evidence showing that the employee used company data and diverted clients through their new company. This could include email communications, client lists, contracts, and any internal data that was accessed or transferred without authorization. You may consider filing a case for breach of confidentiality and fiduciary duty, as the employee used proprietary information for personal gain. Additionally, if the employee stole data or shared it with a competitor, this may constitute theft or unauthorized use of intellectual property, for which you can file a criminal complaint. If you have an employment contract with confidentiality or non-compete clauses, these will strengthen your case. Even if such clauses aren’t present, Indian law still recognizes the duty of an employee to act in the employer’s best interest while employed. You can seek compensation for the financial losses caused by this breach of trust and potentially obtain a court order to prevent further use of your data and client list. It is advisable to consult with a lawyer specializing in business and employment law to assess the evidence, file a suit, and protect your business from further harm.
