Company Laid off and not clearing F&F

Hello Team, The company informed me that they are putting me on sabbatical during covid times. Moreover, they mentioned that if you are getting any other job during a sabbatical then go forward. They refused me to pay my deducted salaries of Mar-Apr-May-Jun around 80k at the time of discussion. They never mentioned any specific date of rejoin. They indirectly laid me off during COVID times when there was no jobs in the market. Hence, I resigned the company in month of July 2020. Now when the time arrived for F&F, they are saying that company is not performing and we cant commit about the F&F. What should I do in this case? Its being 2 months from now from the date of F&F. Any suggestions.

Well, in your case, we should send a Legal Notice first. Then, We will file a case against the Company in NCLT Court for Salary Recovery. We will demand Court to keep on charging 18 percent interest till the time Company pays salary to my client. Thus, you will get interest. However, Interest you will get as and when the Company will be in a better position after Covid times to pay Interest on your Salary which you will 50 percent be receiving after Covid times will get over & for 50 percent that you should get now during Covid times is for what I can put my efforts before court.

Once you have the documents where they have accepted that dues are payable to you, you can send a legal notice for recovering the dues and if that fails, lodge a civil case to recover the monies receivable
