Purchasing products and refurbishing will it cause copyright violation
10-Jul-2023 (In Trademark & Copyright Law)
If am running a company and buying a variety of products from different consumer, then refurbish or recondition and sell it as a Refurbished product,is it gonna trademark infringement,? Ex: Am buying a Hot Wheels Car from a customer , refurbishing and selling it as a refurbished Hot wheels car on a website, Is it gonna cause me any trademark or copyright violations?
Till the time you are not tampering with the brand name (trade mark) of the product, you are well within the limits. But when you sell it in your company's name by changing the name of the product (mark), it will infringe the right of the mark holder.
A trademark right is typically exhausted by the first sale of good or placing the same in market. The basic principle is that once the right holder has been able to obtain economic return from the first sale or placing in the market, the purchaser or transferee of the goods or services is entitled to use or dispose it of without further restriction.
