Legality of selling design softwares to students
10-Aug-2023 (In Trademark & Copyright Law)
I'm a B E graduate, who is good in CAD and CAM. I'm using student free licence software like creo, solidworks, ansys for designing and analysis purposes. Is it legal to sell the design I created to students by using those software's?
The terms of use of AutoDesk states, "free Autodesk software and/or cloud-based services are subject to acceptance of and compliance with the terms of use or other applicable terms that accompany such software or cloud-based services. Software and cloud-based services subject to an Educational license may be used solely for Educational Purposes and shall not be used for commercial, professional or any other for-profit purposes." WHICH clearly means that you cannot use it for commercial purpose which includes you selling the designs that are made out of AutoDesk. The same applies to most 3rd party software companies alike AutoDesk.
The next question that could come to your mind is, "What if I sold?", that's a question of enforceability on the part of AutoDesk.

Before using the software you should have gone through their copyright policies. Student free licence software clearly states that it can be used only for informational purposes and it can not be used for commercial purposes. Any unauthorised use of the software or its documentation can result in civil damages and criminal prosecution . Remember you are infringing the rights of a US company and do not think that you can go unpunished.
If you create designs that are applicable as under then you can sell it
1. Industrial applicAbility is there but not any replicate of some other design
2. You must have invested time to ensure the design is all yours , creativity or novel is important
If you have done so, then you can sell your designs for a reasonable affordable market price , even if you have designed it in a free ware tool ,
