What to do if College is not refunding money ?

my brother has taken in a diploma course but decided not to continue and we have informed the institute before the commencement of classes that he we not enter classes so if they want they can give the seat to any other student.they agreed gor refunding after the deduction of certain amount.but its been 3 months and they r not ready to give any directions even.pls suggest
This a fit case under the Consumer Protection Act, your brother is a consumer and the institute has wrongly charged and/or not refunding without any authority is not refunding the fee deposited.
