The best legal remedy available to you is to file a consumer complaint in consumer forum alleging unfair trade practice and deficiency in service. Both the acts of not providing service and delaying refund independently constitute Unfair trade practice and deficiency in service.

As this is a case of deficiency of service on the part of the Company. You can approach the consumer Court seeking recovery of monies along with the interest and also claim damages both quantified and un-quantified. The Court may also award legal costs in your favour.

Hi
U can very well send the legal notice to the company claiming the amount along with interest and the chances wud be that company wud return the amount after serving upon the legal notice and if then also none action was taken by the company then u can file the recovery case i.e. civil case and also the fraud case in which company will face the penal consequences .
