Suing wedding photographer for not delivering photos and videos

hello si/madam, my wedding photographer is not giving me my photos and video of wedding he is telling that the hard disc is damaged physically due to lighting and its his problem because he must have kept the back up and we have invested around 10 lackh on the over all wedding...i want to literally sue him if he dont give my photos....he is now telling that he will send the hard disc to USA for recovery and it dont have trust on him...so plz help me to get back my photos i dont want compensation i want my photos and videos back...if i dont get my photos how can i cancel his license and i want close his shop

You can claim back the amount. Because it is professional negligence on the part of the photographer. It is his duty to save photos or data in safe format. You send a legal notice intimating him to give your marriage photos withing 15 days time and also sought damages in that. If he is not, then file a consumer case against him and claim your amount with interest and damages.

Sorry to hear your grievance. And you are an Consumer as per Consumer Protection Act, 1986. Send a Legal Notice to him from an Advocate stating that to give back the photos and videos within a specified time or else you will be suing him for damages. Most of the time Notice is enough to get work done if he is lazy & reluctant. Unfortunately, if he has lost all photos and video then you can make a Complaint to Consumer District Forum for his deficiency in service and claim compensation for the loss suffered by you.
