Sending of legal notice for not providing service / fraudulent

I hired a website designing firm in Pune 6 weeks ago and paid 10,000 Rs as advance payment (out of total fees was 22,000 Rs as agreed). He has not designed the website and refuses to come on Zoom, refuses to take telephonic calls, refuses personal meeting to discuss the project. Refuses to make refund. He says I will reply only on email. His office w.as recently found to be closed I need a lawyer to send legal notice on his letterhead to him. The draft is ready.

This clearly amounts to deficiency in service and unfair trade practice under the Consumer Protection Act, 2019. Since you have already paid part consideration and the service provider has failed to deliver the promised work, you are entitled to seek refund along with compensation. Sending a legal notice on advocate’s letterhead is the correct first step. If he fails to respond or refund within the time given, you may file a complaint before the District Consumer Disputes Redressal Commission, Pune.
