Hdfc Bank car loan .NOC not released

Sir i am gaurav from.delhi. Storey is this . I am gaurav and I am doing car sale purchase buainess on commission basis . One of cust vipin sharma has approached me and told his storey that hdfc bank has recovered my car dzire due to non payment of outstanding and on the basis of rohini court magistrate orders. Cust request me to buy that car from.him and pay outstanding to bank . Then customer called the colection officer of hdfc bank where he stated that there is a outstanding of 2.50 lacs on car and then after payment bank will release NOC and car . Then i have made full loan closure payment of 2.50 lacs to bank via cheque mode in march 2o20 Now after waiting for a long time and so many complaints 5o bank i have not received NOC of that car . Now bank is saying that customer is having some credit card as well.as consumer durable outstanding .and NOC will get issued post clearance of all dues. What i should i doto get NOC .

Hello sir, I have perused your query. In these circumstances you have an option to send them a legal notice demanding the immediate issuance of NOC. A stipulated period of 15 days will be given to them by virtue of the said notice to respond to your demands failure in which shall initiate a legal recourse from your side. send a legal notice to the bank stating your claim over the car. Mention in the notice your interest as to the car and you being bonafide purchaser of the car. you have to mention the state of the car as a perishable good and it's diminishing value with time. if they still not proceed with the NOC. we can approach the court on the first date of hearing.

Since bank has taken the possession of the car through magistrate order , then it is important to see whether by that order magistrate had given the bank to sell the said car directly to other party even without auction. If yes then your are entitled for NOC and for that you can file a case against the bank. If not then also you are entitled to the money you paid to the bank for the car along with damages. In both the cases bank has to give answer for their conduct.
