False Cause of Action by Plaintiff

01-Sep-2023 (In Consumer Court Law)
Will the Court dismiss a plaintiffs complaint if the Cause of Action is a Lie. Stage is 'Hearing' with Written Statement submitted by Defendant. Defendant has concrete evidence from government office to prove Cause of Action by Plaintiff is a bold faced lie intended to mis-lead the Hon'ble Court. So, 1. Can the defendant on the basis of the evidence submit to court that plaintiff has committed perjury? 2. Under which order and rule can Defendant ask for case to be dismissed? 3. Under which rule and order can Defendant submit the false Cause of action as fraud.

Sir/madam The law is very clear on the issue of false claims. There can be no relife granted by any court in light of evidence which points out fraud, mischief and misleading statements or information. The court has the power to dismiss the case forthwith. There is no scope that the proceeding can be entertained on the basis of falsehood. please contact us for further details.
