Can I file complaint in consumer court for non maintenance of quarter

I lodged complaint at cpwd, call sewa centre, chd. a Govt. Agency, for repair n maintenance of govt. quarter allotted to me, but they did not pay any attention towards my problem n say we can'nt provide this service at this time as this kind of work is not being undertaken at this time, however government order allow to this. i want to know whether i may go to consumer court for getting relief for the same.

You cannot approach the Consumer forum for this matter as you are not a consumer in this matter and this not a deficiency of service. However, you can approach the Punjab and Haryana High Court directly as the other party is a state authority and is acting arbitrarily. You will have to file a detailed representation to the concerned authorities before filing a writ before the High Court to show arbitrariness of government authorities.

Yes you can file a consumer complaint as you are staying in the quarter for a consideration. However the better way will be to file a writ as it is less time consuming and more efficacious. However before filing writ try to exhaust all the remedial options first

You can not file a complaint before the consumer forum against the government department as you are not their consumer, they have not sold you any thing or sold you their services. If they are not performing their duty then you can file a grievance or in advrse condition file writ petition.

But you cannot file suit before consumer forum.
