03-Nov-2023 (In Consumer Court Law)
Hello Before a year; I've taken loan of 65,000 against the 50.20 gm Gold at HDFC Bank, with the same bank i was using the Credit Card, the same was purely clean when i have taken this Loan but later i have used the credit card and repay my bills but after some moment i stuck in some financial crisis, so that the last bill of Credit Card i couldn't pay till date. But, I have managed to arrange the Loan Amount of 65000 to get the gold back to my home but before a week when i went to bank with the money first they asked to Online Transfer all the money of Loan and later by late evening they refuse to give back Gold by saying "your credit card is unpaid that's why our system doesn't allow to proceed further" and they asked me to pay a minimum amount of Credit Card, which i manged in few minutes but still they forcing me to to clear both bills (CC + GL) and if i don't they keep the gold until i pay both bill which is not possible for me as today' situation.

Dear Client,

Is your issue being resolved?
Given below is the detail that you must follow in order to resolve your issue and if there is any issue feel free to contact.
Primarily you have to register your complaint with the consumer grievance cell with the bank. If your bank does not address your complaint within a month, you can approach the banking ombudsman for deficiency of services.
You have to file the complaint at the office of the ombudsman under whose jurisdiction your bank branch is located. The ombudsman can reject a customer's complaint if he has not approached his bank for grievance redressal first, or if the subject is pending for disposal, or has already been dealt with at any other forum, such as a court of law or consumer court. Also, the complaint will not be considered if more than one year has passed since the customer has heard from the bank, or 13 months since the date of representation to the bank.
If you are not happy with the settlement offered by the ombudsman, you can file an appeal before the appellate authority within 30 days. The appellate authority in this case is the deputy governor of the RBI. Alternatively, you can approach consumer redressal forums, which take up bank-related complaints, or even the courts.
If you need any other assistance do feel free to contact.
Regards,
Tushar Bahadur,
(Advocate),
High Court.
