what to do when neighbour's dog bark at the night

Dear Sir, I have a query. I stay in my own house in kochi - Independent house. My neighbor (for rent) has a pet Pomeranian dog. When people come to their house at night time 12 AM 2 AM and 3 AM it barks continuously and is a disturbance for us.This happens almost every day. My kid who is in LKG has to wake up at 6 to go to school and he is also not getting proper sleep and is falling sick due to this. Is there any solution to this. We talked to them- No use. We tried reaching out to house owner, but since he is not able to find other tenants for high rent he is not reacting at all. Hoping to have a reply from you. Thanks
The solution to this is to sue under law of torts ,a civil offence not amounting to crime.You can also claim compensation from court both from the owner and tenant which is likely to deter repetition of this civil offence.

The best solution is an amicable settlement. There, certainly, is scope for filing a civil action. However, the burden of proof is on your shoulders and would turn out to be quite a heavy burden as the case progresses. Perhaps, serving a legal notice may convince your neighbour to mend his ways.
