A company engaged in managing public parking in various airports. It gets into a license agreement with a airport in a particular state. Few months into the agreement there is a dispute with regards to the quantum of license fee as the area alloted to the company by AAI has been substantially reduced. Futher the company is disqualified from bidding for a tender in other state for parking space since the tender terms state that participants having any pending dues in any project will be disqualified. What is the remedy the company can avail for loss of opportunity in second project?
You can approach or file a Writ petition before the high court of the concerned state which has barred you from entering in the tender allocation process. Since, the issue with regard to dues is a disputed aspect of the matter with AAI, which has altered the size or area given to you or alloted under the agreement. In such scenario, another state cannot bar or preclude you from entering into a tender process- this would be violation of constitutional principles and otherwise of laws regarding tender process.

Review agreement carefully and check whether while place is reduced than fee also like to reduce , if the answer is yes than you can move in court of law if the answer is no than No .
You can file defamation case or profit loss due to ill act of the AAI if the agreement define for reduction of rate and due to conflict fee not deposited and you declare as defaulter.
