What is the rule of law for Indian government
19-Oct-2023 (In Civil Law)
Hi, I wanted to ask the extent to which the rule of law in our country is applied. I wanted to know that any person in the Indian government, from any branch, that is legislation, executive and judiciary, enjoy any kind of immunity in our constitution. When he/she do a crime, when a F. I. R or case is registered against them or when they're proven guilty of a crime, do they've a special privilege or loophole by which they can reduce/postpone the sentence/judgment against them or pardon themselves completely of the crime. Or they're tried in a court of law, according to our constitution like any regular citizen? Does the police arrest them normally as they do regular citizen or do they need special permission? I want to know how does rule of law apply to President, Prime Minister and Chief Justice of India in detail and also everything else. As we're a Constitutional Republic and every citizen have certain fundamental rights that can't be violated by the majority or anyone else.
The Constitution of India intended for India to be a country governed by the rule of law. It provides that the constitution shall be the supreme power in the land and the legislative and the executive derive their authority from the constitution. No special permission is required to arrest a government official apart from the warrant in a non cognizable offence.
