1. What is the legality of a copied CD produced as evidence by complainant. The original SD card is with the complainant as stated by complainant in signed statement. 2. what is the legality of mobile call recorded during the call by the called party and produced as evidence in CD format against the caller?

Audio recordings are admissible as evidence if they appear to be trustworthy, genuine and have been corroborated by other evidence.

Section 65A of the Indian Evidence Act, 1872 states:


The contents of electronic records may be proved in accordance with the provisions of section 65B.

Section 2(1)(t) of the Information Technology Act, 2000 explains "electronic records" as:


"electronic record" means data, record or data generated, image or sound stored, received or sent in an electronic form or micro film or computer generated micro fiche;
