There aren't any explicit central act or law that makes it illegal. Section 268 of Indian Penal Code, which very broadly defines and prohibits causing nuisance to public, can be charged. Since Section 268 does not define a penalty, punishment can be provided as per Section 290. Under Section 290, whoever commits a public nuisance in any case not otherwise punishable by this Code, shall be punished with fine which may extend to two hundred rupees. The offence is non-cognizable, bailable, triable by any Magistrate and non-compoundable. However, Article 47 of the Constitution of India does provide individual states the right to enforce their own laws placing restrictions intoxicating substances for the benefit of its people.
