What Does IA Status Mean in Court?
14-Jun-2024 (In Civil Law)
'IA pending-means an interlocutory (or interim) application has been filed in a case and is awaiting the court's decision; such IAs seek interim reliefs (stay, injunction, interim bail, amendment, etc.) and are heard during the pendency of the main suit or proceeding. Their practical significance is that they can produce temporary, binding effects (affect listing, preserve status quo or grant stays) but, ordinarily, interlocutory orders are procedural and not final unless they affect substantive rights (Central Bank of India v. Gokal Chand, https://indiankanoon.org/doc/1145528/). Courts may also exercise inherent powers to pass interim directions in exceptional cases (Manohar Lal Chopra v. Rai Bahadur Rao Raja Seth Hiralal, https://indiankanoon.org/doc/5192/), while successive or dilatory IAs filed to frustrate finality are condemned and can attract costs or refusal of relief (Indian Council for Enviro'Legal Action v. Union of India, https://www.casemine.com/judgement/in/56ea9784607dba382a0795f2). Parties must serve interlocutory applications on the opposite side before filing; the Supreme Court has enforced this practice (reporting: LiveLaw, https://www.livelaw.in/top-stories/before-filing-interlocutory-applications-they-must-be-served-on-the-opposite-party-supreme-court-reminds-lawyers-308071).
