What are the powers of state women's commission in bigamy cases

my father did second marriage.we complained to police.but they are not helping.they are told that this is non cognizable go to court only.so we want to go state women's commission.what is the powers of state women's commission in bigamy cases ?

Hello,
You have so many remedies under Criminal Procedure Code. First you file a private complaint against your father through your mother only. She is the competent person to proceed with the case. If Station House Officer did not register a case against your father, your mother must complain the same to higher authorities VIZ., Commissioner of Police, Deputy Inspector General of Police, Registrar of High Court, Home Minister for directing the Station House Officer to take action immediately. Even then the Police Authorities did not take action your mother can file a Private Complaint before the concerned magistrate for punishing your father. But your mother must establish second marriage of your father by producing evidence like marriage photos, videos, Wedding Card, Ration Card, Voter Id, Adhar Card of your father and that other woman etc., If your mother failed to prove the same your father will not be punished. You mother must take legal assistance by engaging an expert advocate who deals the cases of bigamy and other related criminal cases.

State Women's Commission is vested with powers of addressing women's complaints. However, the Commission will only have jurisdiction to inquire into complaints to arrive and ascertain the existence of a prima facie case of violation but should not proceed to adjudicate upon complaints or indict respondents or grant specific reliefs. No doubt it may be necessary for the Commission to delve into the facts but it must not arrive at conclusions or grant reliefs. It may however make recommendations on the basis of such facts in the larger interests of women. Therefore, to get proper relief, approach jurisdictional criminal court and file a complaint under 494 IPC . The court will adjudicate the case.
