What are daughter's rights over father's property

15-Jun-2023 (In Civil Law)
1.I would like to know if I have equal rights in my fathers property which was given to him by grandfather. Not sure if it was gifted. 2.I have a brother and would like to know if he is the only legal heir or am I also eligible. 3.When my parents are unwilling to treat me equally and refuse to accept my request what are my available options. 4. There is another ancestral property where they convinced me for 20% and registered a settlement deed in 2011 and says absolute and irrevocable. So do I have chances to claim more when my rights are equal for ancestral property.

Hi,
After an amendment made to the Hindu Succession act, 1956, in the year 2005 , daughters are being recognized as coparceners. Meaning thereby Daughters shall have equal rights as that of son in all matters whatsoever. So legally you are entitled to equal share in ancestral property of your father. As far as separate property is concerned which maybe acquired by father by his own skill and money, it will be his discreation how to distribute property by making will. But if he dies without making a will , again you along with your brother shall have equal share in separate property as well.
