Person staying in the above flat always throw garbage and water from above that water falls inside our bedroom and we have complained several times but managing committee is not taking action against him as he is member of that committee. This time when we gave complaint in writing that if they don't take this matter seriously we will stop payment of maintenance, they gave reply that whatever allegations you have stated are false and you can't threaten to stop payment of maintenance. Please guide regarding this.
you write to the managing committee as well as the member throwing garbage and mark a copy of your complaint to the registrar's office.
and do not stop the payment of your maintenance. in the complaint that you wrote please ensure to mention that despite you paying maintenance charges for the beautification of the society you are not having a healthy environment .

You can obviously stop paying maintenance. You can force other committee members on the Society's Board to terminate the service of their counter-part or colleague on the board acting as a Committee Member, despite that not following the basic ethics and norms of how to live in a particular society. If the Committee Members don't terminate his services, stop paying maintenance. If they opt for a legal recourse to solicit maintenance from you, then I am with you to defend you . You can from your end initiate a legal step by filing a Civil Suit of Nuisance in the concerned Civil Court against the Neighbour living below your floor & who is also the Society's Committee Member.
