Validity of Special power of attorney

08-Dec-2023 (In Civil Law)
I am Housewife. My cousin lives in UK. He helped me financially for my daughter's marriage and said I need not to return. Later, because of some personal grudge, he wanted his money back with 3 rupees interest and he gave a special POA (for court proceedings only) on 100 rs stamp paper to his own brother (who lives in India) to sue against me and a civil suit was filed against me by the POA holder. I want to know that can a POA holder file a suit in the court on behalf of the principal? If no, under which section?

hi yes he can file the suit through power of attorney but as you said that he said that he need not return the amount was there any agŕeement made between you and him and if there is no agreement you could contest the case and need to see the case papers filed by him
