Using residence basement as a godown for dumping civil material .

Ours is a purely residential colony. Infront of my residential banglow there is my neighbours bnglow. He is using his basement as godown for keeping the centring & civil material. Frequently his tempo & truck is coming to load the material from godown and unload the material brought from constriction sites. The heavy vehicles are coming in the area to dump the material, the colony drinking water pipelines broken number of times. We have getting it repaired from by informing Munci pal corporation. Due to his daily activity my family members are disturbed. My children's getting disturbance in their study. This is being residential area then how he can use his basement as dumping godown. Can we file a complaint.

This is my response to you: 1. You can file a complaint to nearest police station for the nuisance this person created; 2. You can also send a legal notice to him; 3. Last step is to approach court and obtain stay order on all his operations; 4. Consult a local lawyer and take steps

You can go for filing of a Private Nuisance. A Private Nuisance interferes with the right of a specific person or group of individuals distinct from the public at large. The remedy in an action for private nuisance is a civil action for damages or an injunction or both and not an indictment.
