Dear Client, Since you have a notarized stamped agreement, signed and with photograph of the buyer, the transaction has legal validity. The buyer’s denial will not stand if you have proper documentation and proof of payment. You should immediately: 1. File a Criminal Complaint under Section 420 (Cheating) and Section 406 (Criminal Breach of Trust) of the Bharatiya Nyaya Sanhita, 2023 (corresponding to IPC 420 & 406) before the local police or magistrate. 2. Send a Legal Notice through an advocate demanding the pending EMI and total due amount within 7–10 days. 3. If the buyer still denies or does not pay, file a civil recovery suit under Order 37 of the Civil Procedure Code (Summary Suit) for recovery of ₹11,20,000 with interest. 4. Keep ready all proof — stamp paper agreement, buyer’s photo, notary seal, and transaction details. These will be strong evidences in your favour. The notary and stamp paper agreement along with buyer’s signatures and photos are legally admissible, so you can recover your money through both civil and criminal proceedings.

In your case, the buyer’s default and denial despite having executed a stamped and notarized agreement with signatures and photographs constitutes breach of contract and cheating. You should first issue a detailed legal notice through an advocate demanding full payment or return of the truck within a specified time. If the buyer fails, you can file a civil recovery suit for the balance amount and damages, and also lodge a criminal complaint for cheating and criminal breach of trust. Preserve all documentary and photographic evidence, including the stamp paper, notary record, and payment details, to support your claim.

Based on your description, since you have a notarized stamped agreement, buyer’s signatures, photos, and other proof of transaction, you have sufficient documentary evidence to prove the sale. You should immediately file a civil recovery suit for the balance amount and also a criminal complaint for cheating and breach of trust under relevant IPC sections. Along with that, send a legal notice through an advocate mentioning the details of the sale, EMI default, and denial by the buyer. Keep all documents, payment proofs, and communication safely as they will be strong evidence in court.
