Tenant landlord shop vacant dispute

I m landlord who wants to get his shop from tenant...on the basis of bonified need as i m unemployed court ordered to vacant premise ... Even after this tenant reached to Adj cort and there also he was ordered to vacat..ow i want to know that if tenant goes to high court but since i m unemployed and its is my bonified need is there any provision toget rent from tenant till he fights in hight court because it is my bonified need and i m unemployed nd donot have any way to earn... I have a technical degree in medical and its my bonified need ... So i want montly rent as per circle rate till case goes on in high cout. Is there any such rule or provision.

now as per your story tenant has filed rent control writ petition in High Court you want to know weather there is any rule regulations under which you can seek monthly rent from the tenant. you can move an application before the high court for the enhancement of the rent during the pendency of the writ petition under article 226 the honourable High Court has inherent power and can enhance the rent but it may not be as per Circle rate. I would like to advise you to make efforts to dispose of writ petition.
