To obtain a birth certificate without hospital proof, the Registration of Births and Deaths Act of 1969 governs the process. Your friend must file an application for a delayed birth certificate before the Magistrate’s Court under Section 13(3) of the Registration of Births and Deaths Act, 1969 Act. The jurisdiction typically lies with the Judicial Magistrate First Class (JMFC) or Executive Magistrate of the area where the birth occurred. Upon receiving the court order, she can submit it to the Registrar for issuing the birth certificate.

Below are the steps to get the birth certificate 1. Get a non availability certificate from the local municipal office. 2. Gather proof of birth that is school leaving certificate Aadhar affidavit from parents/ relatives/ Hospital midwife record if any 3. File an application at the municipal office with supporting documents 4. Approach the court (if required), if the birth was not registered within 1 year get an order from the magistrate. 5. Submit Court order and pay fees, once approved, submit and order to Muncipal office 6. Receive the birth certificate, after processing collect it from the municipal office or download it online
