You can file a civil suit for declaration and mandatory injunction before the jurisdictional civil court. The prayer should seek (1) a declaration that your new name as per Gazette Notification is your correct legal name, and (2) a direction to CBSE to issue fresh certificates reflecting your new name. Once the court passes the order, CBSE is legally bound to comply. Keep your Gazette notification, ID proofs, and old certificates ready as exhibits. The process usually takes 3–6 months, depending on your local court’s workload.

To change a child’s name in CBSE Class 10th or 12th marksheet through a court order, the first step is to file a Civil Suit for Declaration before the competent Civil Court. In the plaint, you must request the court to declare that the correct name of the child is the new name instead of the old one recorded in school and CBSE records. It is important to attach the child’s birth certificate, school records, and identity proofs showing both names as evidence. After hearing both sides, if the court is satisfied with the reasons and documents, it will pass a decree or judgment declaring the new name as correct. Once the decree is obtained, you should apply to the CBSE Regional Office for correction or change of name in the marksheet. The application must be accompanied by a certified copy of the court decree, an affidavit, Gazette notification (if available), copy of the old marksheet, Aadhaar card or other ID showing the new name, and a letter from the school principal confirming the student’s identity. CBSE, as per its Examination Bye-laws (Rule 69.1), will verify the documents and, upon satisfaction, issue a revised marksheet reflecting the child’s new name.

You will need to file a petition for declaration and mandatory injunction before the jurisdictional civil court, attach your Gazette, ID proofs, and justification for the change. Once the court issues the order, CBSE is bound to comply. I can guide you with the drafting and procedure if needed.
