Store Garage & Terrace Rights in LIG DDA Flats, Kalkaji

05-Sep-2023 (In Civil Law)
The person staying on our ground floor blocks our store garage and keeps arguing that we don't have the right to open every day.Similarly, the terrace, where we have a 1 study room setup, says that the terrace is a common space and he demands the keys from us. We have never denied his request to check the water tank that is kept on the terrace. But sharing terrace keys has security concerns. What should we do?

person in ground floor portion does not have any right to question you for using your garage on ground floor. garage is your property and you have every right to use the same as per your own wisges. though terrace is a common area meant for use of tank, antena etc. you can deny to share keys by citing the valid reason.

Hi, Going by the limited information provided by you, it is essential to see the documents as to what eights you have of that property and send him a legal notice asking him to be in his property and let you enjoy your property otherwise legal action will be initiated against them. The legal action may be criminal and civil depending upon what you want. We can discuss it over a call for a sane legal advise.

Restraining you to open the garage is an offence under IPC, therefore you must initiate an apprehension complaint regarding the same. If you have terrace rights than he is not suppose to ask permanent keys from u ! Kindly b in touch if u want us to draft the said apprehension complaint! Thanks

Hi, It is crucial to first see what rights have been conferred on you as per your sale deed, if it mentions exclusive terrace rights then other residents of the building only have a right to have access to water talks at reasonable times after taking your consent. Likewise his assertion that you are not entitled to use or open the store everyday has no basis in law. It is advised that you send a strongly worded legal notice and if that fails approach the civil court for declaration qua your rights and injunctions against your neighbor.
