Society Retaining My Share Certificate
24-Jan-2023 (In Civil Law)
I recently purchased a flat at Pune and my civil contractor unknowingly pasted tiles in the both my balconies (as we were not informed while pasting), now the Society secretary wants me to remove the tiles and then he will give my share share certificate....my question is how this matter is related to my Share certificate??? Is there any such byelaw of retaining my share certificate jst becoz of tiles?? Ihave paid all the transfer fees all dues...please help..
you can sue the society by first sending a legal notice and next by moving a suit and getting an injunction order from court. If you have provided the society with all the documents which we required after transfer then they should have given you your share certificate.
issuance of share certificate is nowhere related to the issue if tiles.
you should inform the society managing committee, that despite paying all the dues and having no outstanding amount to be paid the secretary is harassing you and mentally tourturing you.

the member may apply for issue of share certificates under section 22 read with rule 19 of cooperative society act. the society may reject the application on reasonable justification with 60 days. in event of no expressed rejection within 60 days. applicant is deemed to be considered a member. in event of any further dispute the aggrieved party may file appeal under section 23 of the act. for further details please call me.
