Society member complained to police for cutting their water supply

We like to inform you that One member of the society has complaint the police that we have cut the water line for not paying the dues. We also like to inform you that this Resolution was already passed In AGM at we can cut the water supply line of the flat of member who does not pay the dues regularly ask them to take water form the ground tap. can you please help us whether it is right or wrong.

Hello Society I hope you are chairman or Secretary even if you have this decision without or against vote you cannot disconnect water supply or electronic supply You are not providing those facilities to them, you have no right and authority for that. He may file case against you and penalties and ask for compensation for your act.

Have you served them notice give a specific date for submitting the bill before you will take such a action . I would further like to know if it is a registered society and what are the guidelines in the society agreed upon . It is wrong act under the law as right to water is being impriched

its not legal to disconnect basic supplies due to non payment of dues. you can file a 101 proceedings under maharashtra cooperative societies act. but you should now immediately restore the water connection to avoid further police problems.

Basic amenities cannot be denied as it is require for day today's life. You may proceed as per the law, you may issue notice of demand of payment of outstanding dues. Even if there is resolution of AGM, that itself is not a law. Therefore for recovery of dues you may file proceeding before Co.Op. Registrar for Recovery Certificate.
