Selling loan bike 34 emi pending

Someone have sell me loan bike and that bike he took from other person name only he has given his own check for emi . His 4 emi has been default and 30 emi is still pending i just went to service centre for 2 free service they have taken my number for otp after one month company phone me for emi default.bcoz he has closed his mobile so that they calling me also he has done fake signature in noc letter but I have taken his hand stamp and aadhaar card xerox now I dont know how to recovered my 41000 money if i complain to polise they will took bike from me customer care calling me again and again plz do reply me for this situation and if they closed him in jail he will free in 2 days
