Selective Delay in case of government recruitment

28-Sep-2023 (In Civil Law)
Hello Legal Experts, I need an opinion on following matter : I was selected for the post of teacher in a Navodaya Vidyalaya Samiti (which is a central government school system like KVS ). NVS gave joining to candidates two months ago but I am still not provided joining. My marks are among top scorers , so it can not be a case of waiting list. I contacted NVS through RTI and received response that my candidature is pending for decision. But cause of delay was not provided citing that Information Officer is not liable to provide reasons. I have raised a grievance through public grievance portal which is pending at the end of NVS (by same official who responded to RTI) Now, they have started hiring candidates on contractual basis. The recruitment process already took a lot longer time due to pandemic. My queries are : 1. What is the cheapest and fastest way I can get my joining letter ? 2. Can I get compensation ?

File a writ of mandamus in the concerned High Court having competent jurisdiction, and seek directions with respect to your immediate joining. Seek a stay on the ongoing contractual appointments, in case these appointees are being recruited at the place of regularly selected candidates like you

Namaste with respect to first question yes fastest way is to approach high court under a writ petition for directions to disclosure of the reasons. compensation not so sure as depends later how your case goes. For further information on this contact me with the registered mobile no with lawrato.
