Second apoeal for permanent injunction

30-Jan-2023 (In Civil Law)
The defendants, our neighbour, are the dominant users of a right of way that passes under a porch in front of our house door. The porch has a height of 8 ft 8 in and has been in existence since the right of way was granted. In 2014 a truck came into our property and being higher than the porch smashed it to pieces. We filed a case against the defendants. The defendants claimed to be ignorant as to ownership of truck. We therefore lost the original suit and the appeal suit. Subsequently it was learnt that the defendant was a Director of the company that owned the truck. The case was lost because of fslse statement given by Defendant attracting IPC 191. Can we file Second appeal.

No, second appeal will not be applicable. You can file a petition for perjury against the defendants for giving false statements before the court of law and obtained a favourable order by dismissal of the suit. You need to include credible evidence towards the same.
