RWA Registration without any formal Notice

I owned a flat in a society of 30 resident flats. Some people have formed RWA by seeking the majority & registered it. However, I have not received any formal communication to vote for RWA. My questions: a) can RWA register without my consent or i can challenge it as i am flat owner & not received any formal communication or signed any by laws, registration documents or given any resolution? b) received maintenance dues notice which i want to challenge because of no notice

Well, it was mandatory on the part of those constituting RWA to inform you in advance of their intentions to form & register RWA. Since you have not got any notice to vote for Registration of RWA, it is illegal. You can challenge such formation of RWA along with Notice which you have received regards your Maintenance Dues!

In most cases, registering a Resident Welfare Association (RWA) in a housing society does not require individual consent from each member, especially if the society is registered under the Societies Registration Act, 1860. Once a majority of residents have booked their flats, the RWA can be formed, and all owners become members, regardless of individual consent.
