RWA notice for Flat Maintenance Dues Pending
09-May-2025 (In Civil Law)
I owned a flat in a society of 30 resident flats. Some people have formed RWA by seeking the majority & registered it. However, I have not received any formal communication to vote for/against formation of association. RWA has sent pending maintenance notice & to stop common service area. My private parking has been vandalized by RWA due to non-payment which they deny. I want to challenge pending maintenance notice due to no information & immediate action to not stop common services.
You should review property documents and bylaws, and formally request charge details and membership clarification from the RWA. Obtaining the RWA's registration and bylaws is crucial. Legal advice is recommended to assess the notice's legality and the service disruption threat. Arbitrarily stopping essential services for disputed non-payment is likely illegal. Prompt communication, document review, and legal consultation are vital to protect your rights. For tailored advice, detailed case documents are needed.
You are advised to challenge the legality of the RWA's formation by obtaining its registration details and verifying compliance with legal procedures, issue a legal notice disputing the maintenance demand due to lack of proper communication, file a complaint with the Registrar of Societies if the RWA was not formed legally and a police complaint for vandalism of your parking space, and seek an interim injunction from the court to prevent disruption of common services until the dispute is resolved. For further clarification feel free to reach out.
It's advisable for you to first of all rather than going legally you should serve them a legal notice and in that notice you can write either stop all these harassment or face legal action which will be at your own risk. After that if they fails to give you a satisfactory reply then you can anytime send a complaint regarding your grievances in writing to the police station according to your jurisdiction.
Hi. This is the usual issue faced by most ppl in Delhi NCR, where the RWA starts acting like a bunch of goons. In your case depending upon the exact facts and circumstances of your case we can file an FIR and challenge the maintenance and seek necessary injunction. Feel free to connect to discuss the same.
