Roof rights are sold to top floor owner

I live on the top floor and also have the roof rights with me. The people living on floors below come to check their water tank level everyday. I get disturbed by this. Is there anything i could do?

whether neighbours can inspect water tank depends on the sale agreement. however inspection can be done only during reasonable hours of the day and with reasonable cause otherwise permission to inspect tank can be denied.

yes, send them the legal notice stating that the tank can not be checked everyday as it breach your peace and, allow them one day in a week to check their tank. also mention that in case of any emergency or any water issues, prior approval to access the roof will be required. If that is not maintained, a court order to that effect will be obtained.

Unfortunately, the Builder - Buyer Agreement always gives rights to water tank in their agreement. This is the norm but you can check for your building. If your agreement mentions exclusive rights on roof and it conflicts with the lower floors residence. You may hold responsible the Builder for compensation.
