Rental notice period conflict with owners
23-Sep-2023 (In Civil Law)
I was staying in a rented apartment for past 9 months. The agreement is for 12 months with a notice period of 1 month. The owner asked us to vacate early because they want to sell it. We found a property before one month but the owner says we are entitled to pay one month rent even though they asked us to move before the agreement lapsed. Is it like that?

Not required to pay one month rent. it is for their reason you are vacating. You can pay the expenses towards any damages incurred during the lease period.

It all depends upon the terms of your agreement Without looking into the agreement it is not possible to give any opinion

Your owner is cheating you. Usually the agreement is made for 11 months or 12 months with a mention of the rent payable monthly during the agreement period. On cessation of the agreement period the rentals will be revised by executing a new rental agreement. In your case or in any case if the person vacates the house during the agreement period he/she has to give the notice to the owner for one/two/three months as mentioned in the agreement. Whereas in your case the notice period is one month to vacate. Generally if a person vacate without providing the notice of one month then the person is are liable to pay the rentals for that particular month. However in your case since the request to vacate was made by the owner and since you have found the house very early, you are not liable to pay any rentals to the owner.
