If she is no longer the owner of the land she can’t have the right to transfer it to any one. Your brother being the owner now enjoys the right to transfer the property as and when he likes and its his discretion to do so or not to do so.

This suggestion only.your mother is alive you have not mentioned in your question. The said property is your mother's property or your father's propertyor inherent property. The answer is not stickly on your question.Under which Act the said property has to distribution. However under the muslim Law the distribution of property is male has to received 2 shares, female has to received 1 share, mother's share is 1/8 =12.50 ( 12.50 -100= 87.50 balance ). Firstly deducted mother's share, thenafter others shares means that balance of 87.50 ( goes to 2/3 males and 1/3 famales of the said balance) the shares after demise of parens only. Under Himdu Law all are equal shares in the all properties.Futher your question is not clear one
