Regarding my rejection in aiims cre 4 in post of ot technologist
18-Apr-2026 (In Civil Law)
Sir I have applied for the post of ot technologist cre4 held in 22 December where I got 31 all India rank and I have selected option of aiims bilaspur where they have alloted me aiims.bilaspur .....After that docoment verification has done on 16th march 2026 where I m rejected due to age criteria they told age relaxation is not given to aiims new delhi employe. According to rule 3 year regular service can claim for age relaxation what it is not given to me they told aiims is autonomous body
Legal remedies available:
File a representation/appeal before the recruiting authority seeking reconsideration.
If rejected, approach the Central Administrative Tribunal (CAT) (if the recruitment falls under its jurisdiction).
Alternatively, file a writ petition under Article 226 before the High Court challenging arbitrary denial of age relaxation.
Even though institutions like AIIMS Bilaspur or All India Institute of Medical Sciences (AIIMS) are autonomous bodies, they are still “State” under Article 12 of the Constitution and are bound to act fairly, reasonably, and in accordance with their own recruitment rules and constitutional principles under Articles 14 and 16.
If the recruitment notification or applicable service rules clearly state that candidates with 3 years of regular service are entitled to age relaxation, then denial of such benefit on the ground that AIIMS is an autonomous body is not sustainable unless:
there is a specific exclusion clause in the notification, or
the relaxation is expressly limited only to certain categories (e.g., central government employees only, excluding autonomous bodies).
Key legal points in your favour:
If you have completed qualifying service as per rules, you are entitled to equal consideration.
Arbitrary denial of relaxation amounts to violation of Article 14 (equality) and Article 16 (equal opportunity in public employment).
Autonomous status does not permit deviation from notified recruitment conditions.
Immediate remedy:
You should promptly file a writ petition before the jurisdictional High Court under Article 226 challenging the rejection. You can seek:
Quashing of the rejection decision,
Direction to consider your candidature with age relaxation,
Interim relief (if the selection process is ongoing).
Also ensure you have:
Recruitment notification
Proof of your prior service
Rejection communication
Important: Timing is critical. Courts are more inclined to grant relief if approached without delay, especially before final appointments are made.
In conclusion, if the rules support your eligibility, the rejection is likely arbitrary and can be successfully challenged through a writ petition.
You should first file a detailed representation to the recruiting authority seeking reconsideration. If no relief is granted, you may approach the Central Administrative Tribunal (CAT) by filing an Original Application, as the matter concerns recruitment to a government institution. You can seek quashing of the rejection and direction to consider your candidature with age relaxation.
you must immediately approach the High Court with a writ petition and seeking a declaration in your favour.
if the rules permit you're appointment cannot be declined by AIIMS
AIIMS is not an autonomous body, it is funded by the government and therefore comes under the jurisdiction of filing a writ petition
