Regarding Indemnity bond of PSU Bank

05-Jul-2023 (In Civil Law)
My sister got selected as a specialist marketing officer through Ibps, during document verificstion process she signed an indemnity bond previous month of 2.5 lacs for 3 years service including probation period. Today at the date of joining she got to know that she has to do field sales only without any training from the first day with rigorous timings and far off location to travel, so she wants to leave the job from the first day of joining itself because marketing and sales are two different things she was not aware that she had to field sales after passing three stages of exams, does she have to pay the indemnity bonds amount without working for even a single day. Please answer as soon as possible, what could be the possible remedies. She hasn't even submitted the forms like savings account, NPS, bank id forms etc. She just wants to leave and traumatized after knowing their work culture. So please help by telling some way out of this.

Since you have signed the indemnity bond then the company will obviously wants you to indemnify itself in case you leave the job. But if it was not clear regarding the marketing and sales processes then they have done 420 against you. You can just send them a legal notice regarding your grievances or if you wish to go legal then you can also file a written complaint with the police station of your area. For more legal assistance I am just a call away.

any bond that imposes unreasonable terms and conditions on employment is not valid as per Indian contract laws. since your sister has not worked even for a single day and the employer has not spent a single paisa on her training it would be very difficult for the employer to recover compensation from your sister in the event that she does not join service. therefore your sister does not need to worry on this aspect.

The basic standard in India is followed as below: Your sister must serve the notice period. She must be serving probation period, so during the probation period she can serve the company a notice to quit the job and to not join it for some personal reasons. Your copy of bond papers/signed documents must be read carefully once. You can not be forced to join without your consent, but as you have signed the documents you must follow the notice period aspect.
