Regarding Gratuity Act (Pvt. company) and EPFO in death cases

My husband died in August 2019. He was serving in a private limited company and covered under EPFO scheme. We lived with our mother-in-law and my late husband has a little brother. Please help me to know that after his death, without filing any nominations: 1. Who is eligible to get EPFO payments like Balance in my husband's account and Insurance as applicable under EDLI. Me or my mother-in-law or we both get equal shares? 2. Who will get the gratuity/bonus from the company without a nomination filed? The company are pressing me to write that I agree to pay 50% dues from company to my mother-in-law and say that If i dont do it, Then i'll not get anything. Whether this will also be divided equally amongs us two i.e. me and my mother-in-law.? 3. About pension from EPFO? My husband served in Kundli, Sonipat, haryana. I am living in delhi with parents now. My email id is [email protected] (brother's id) Please help. I have no kids and have no income source to survive.

You must not agree to the terms/conditions mentioned by the company as you said, unless you are fully satisfied by those. You must communicate with the company through legal adviser, to achieve the success.

in this case if a will does not exist after after the death of the person all his properties Including the EPFO Or money in the bank will be equally divided among all the legal Heir. bus in your case Money will be equally divided between you and your mother in law.
