Refund of school fees for nursery class

I had admitted my son to a school with 80k donation fees but just after 2 months he started getting so many wheezing/asthma attack that it was unbearable. So i had to move him to a different city.I had paid 36000 as tuition fees also, 37000/- was remaining to be given after 3 months. I asked for refund of admission fees but school denied saying it is non refundable, can i take any legal help?
